In Isaac v. State, delivered on November 9, 2011, by the Court of Appeals of Texas Fifth District Dallas, Nathan Nakeal Isaac was convicted in the 59th Judicial District Court of Grayson County for one count of Assault Involving Family Violence with a prior conviction for an assault against a family member and one count of Aggravated Assault with a Deadly Weapon, specifically a knife, under Tex. Penal Code Ann. §§ 22.01(a)(1), (b)(2)(A), 22.02(a)(2) (2011). Isaac appealed, challenging the sufficiency of the evidence supporting his convictions. He contested the trial court’s determination that bodily injury occurred from the assault and argued that the knives used did not constitute deadly weapons as defined by law.

The appellate court affirmed Isaac’s convictions, finding legally sufficient evidence presented at trial. Witnesses testified that Isaac, during an altercation with his stepfather Lindsey Knox, threw a telephone at Knox’s head, causing a visible injury, and later emerged wielding two knives, which witnesses described as capable of causing death or serious bodily injury. Despite Isaac’s contention that the physical harm was minor and that he was immediately stopped before he could use the knives, the court determined a rational jury could find bodily injury resulted from the assault and that the knives were used in a manner that could cause serious harm.

This case highlights the broad interpretation of “bodily injury” and “deadly weapon” within the context of family violence and aggravated assault convictions. The court’s reliance on witness testimonies and evidence, including the physical injury and the nature of the knives, underscored the sufficiency of the evidence to support the jury’s findings. Isaac’s appeal was overruled, and the trial court’s judgment was affirmed, reinforcing the legal standards applied to assault and aggravated assault charges.
