The information and opinions we publish about criminal law on this website reflect our experience as practicing lawyers and focus on topics that interest the public. When most people think about criminal law, they think about criminal offenses. But criminal law actually encompasses a broad spectrum of matters.

Most topics in criminal law can be divided between federal criminal law and state criminal law. The reason for this is that in the United States, the federal government and state governments each have their own set of criminal offenses, procedures, rules, and law enforcement agencies. These two “sovereigns” often have overlapping jurisdiction and interests.

However, some issues in criminal law reach across the divide between federal and state governments. These topics include federal constitutional rights that preempt state laws and rules, certain post-conviction appellate processes like writs of habeas corpus, and federal laws that require state implementation (including sex offender registration laws).
