Have you been arrested for a Sex Crime? What can you do to defend yourself?
Whether you are facing a Texas state Sex Crime charge or a federal Sex Crime charge, Sex Crimes cases feature emotionally-charged investigators and witnesses. Often these cases involve detailed forensic evidence like DNA or digital forensic evidence.
The best Sex Crimes defense strategy demands a mix of cutting-edge science, traditional investigative resources and the mastery of digital and forensic technology. We have achieved numerous significant Sex Crime defense victories with our extensive investigative resources and insights into complex constitutional law in cases including recent dismissals of possession of child pornography charges, aggravated sexual assault charges and indecency of a child charges.
How do attorneys handle forensic science in Texas sex crime cases?
Many people incorrectly believe forensic science is beyond challenge, but as experienced defense lawyers know, science is subject to error, both human error and error from the methods used by investigators.
Not every Sex Crime case come down to science. In fact, often cases come down to key witness testimony. Sometimes that witness is a sympathetic (but lying) victim. Some cases come down to one of the many complex social relationships or situations regarding age of consent. In any case, digital forensic evidence, science and the complex nature of human relationships all play an important role in crafting your defense.
Are you under investigation for a Sex Crime? Should you cooperate with the police investigation?
We have assisted our clients through many difficult police interrogations. Although we do not typically recommend consenting to a police interrogation or interview, there are circumstances when we consider it. However, you should never do a police interview without your lawyer present.
When police bring you in for an interview, they already believe that you committed the offense. Accordingly, this belief will inform their interpretation of your answers. Generally, when people believe something, they will only see things that confirm their belief. This is called confirmation bias, and this is what leads to police charging innocent people with crimes.
The arrest alone for a sexual offense can drastically change your life even if you are ultimately found not guilty, so do not hesitate to contact us immediately if you are under investigation.
In addition, remember that people do not usually communicate perfectly clearly under intense pressure. The extreme stress of a police interview can cause you to say something that police then misinterpret. And even the way you look during the interview significantly impacts the police decision to arrest you. For all of these reasons, we carefully consider the decision to interview because it will have a huge impact on the ultimate outcome your case.
In some cases, we have communicated directly with law enforcement authorities on behalf of our clients instead of consenting to a direct interrogation. These are dangerous waters, and we are here to help you with experienced Sex Crime legal representation.
What are the penalties for Sex Crimes in Texas?
The penalties for Sex Crimes in Texas run the gamut, from misdemeanor to felony charges of every degree. You should click on the articles above to learn more about the penalties for each offense.
Many Sex Crimes will require you register for the sex offender registry upon conviction and continuing on for up to the lest of your life. Additionally, Sex Crimes convictions can remove you from eligibility for many forms of sentencing alternatives, record clearing, and civil liberties. And proceed with caution – even deferred adjudication plea deals (where a judge never finds you guilty and ultimately dismisses the case) have the same impact as convictions.
For many Sex Crimes, after a deferred adjudication plea, you will still have to register and never be allowed to clear your record. If you have any questions about what a plea means for your permanent record, schedule a consultation with our Texas Sex Crimes Attorneys.

Bond Conditions in Texas Sex Crimes Cases
If the police have arrested you for a Sex Crime, then Texas Code of Criminal Procedure §17.40 requires Texas judges to “impose any reasonable condition of bond related to the safety of a victim of the alleged offense or to the safety of the community” to secure your attendance at trial.
For Sex Crimes cases, these bond conditions often take the form of no contact with minors, no access to the internet, or ankle monitoring.
Texas Sex Crimes Attorney Defense Strategy
Getting the best result in a Sex Crimes case requires being fully prepared for all hearings and court settings – not just trials. As soon as you hire us as your Texas Sex Crimes attorney, we get to work. And when we get on a case, the state knows that we are already getting ready for trial and going for an outright acquittal.
But the preparation often starts even before the case begins. From the moment that the police initiate an investigation or make an arrest, we have work to do. We do our own investigation. The state has police and investigators of their own working on the government dime, and we can’t afford to let their evidence stand uncontroverted if you want to win.
What to Do if Falsely Accused of Sex Crimes
Even if someone has falsely accused you, you should still always take this charge very seriously. You may think that the state may “drop charges” against you. But absent effective advocacy by a lawyer, the state usually will take the case to trial and “let the jury decide.” If the state has charged you with Sex Crimes, or you are under investigation for the offense, then you should contact us as soon as possible.
